10 Years in Jail for Sex Offence

High Court in Siaya county revoked a three years probation sentence that was given by Bondo Law Courts against a 61 year old man who was found guilty of defiling a 12 years old girl.

 The man identified as Charles Zaddock Oriwo is said to have committed the offence on 19th September 2020 at around 4.30pm in Nyagoko village, Rarieda sub-county where he is said to have dipped his hands into the girl’s private parts.

According to the child, Oriwo entered the kitchen where she was sitting together with her little sibling and when he realized that there was no elderly person around, he pulled her closer to him, lifted her dress and dipped his fingers into the girl’s private parts.

The case was presented before resident magistrate S. Mathenge at the Bondo Law courts on 1st July 2021 and Oriwo was found guilty and was given three years probation sentence. However, the Director of Public Prosecution presented a petition for the case to be looked into a fresh, claiming that the judge was too lenient to the offender despite that he went against section 11(1) of the sexual offences which provides that such a person be jailed for 10 years.

After going through the case again, Lady Justice Roseline Aburili at the Siaya County High Court ruled that the case be taken back to the Bondo Principal Magistrate’s court and the man be sentenced to a jail term not less than 10 years which will be counted starting 26th August 2021.
